Subdivisions



    Subdivisions are broken down into two categories, major or minor subdivisions.

    The Lake County Planning Commission oversees both major and minor subdivisions in the five unincorporated townships in the County; Concord, Leroy, Madison, Painesville and Perry.

    Lake County Township Major Subdivisions

    Major Subdivision Process:  includes the reviewing of new roads and sublots by the Lake County Planning Commission in the unincorporated areas of Lake County. This process is described in the Lake County Subdivision Regulations which were adopted by the Board of County Commissioners through ORC 711.10.

    Major Subdivision Review Process:  also includes a review from various agencies and comments from the public during the preliminary plan review and the final plat review process.                                                                                                        

    The Lake County Planning Commission has the authority to approve or disapprove subdivisions at their monthly meeting, which is usually the last Tuesday of the month.  

     

    Lake County Township Minor Subdivisions

    In accordance with O.R.C. section(s) 711.131 and 711.133, the minor subdivision process is an administrative function to divide property in the Townships. Commonly referred to as “lot splits”, the staff of the Planning Commission reviews deeds and survey drawings to determine if a property can be divided and still conform to the local zoning resolution and other applicable rules (household sewage treatment). 


    The minor subdivision process includes a review of new buildable lots and transferring of property between adjacent property owners.  Any lot that was created in a subdivision under O.R.C. 711.10 can only be divided by a lot split plat and must be approved by the Planning Commission at a regularly scheduled meeting.
     

    LCPC staff is dedicated to reviewing completed submittals in a timely and professional manner, often approving the split quicker than the seven (7) business days provided by the O.R.C.  LCPC staff reviews the following types of minor subdivisions:
     

    • Lot Split

    The proposed division of land that involves no more than five (5) lots (4 splits and 1 remainder lot) after the original tract has been completely subdivided. These lots are to be five (5) acres or less and must conform to the zoning standards of the community in which they exist and evidence of sanitary sewer service or documentation from the Lake County General Health District noting the feasibility of a household sewage treatment system must be provided. 
     

    • Large Lot Development

    The proposed division of land into buildable lots ranging from five (5) to twenty (20) acres. Resulting lots must conform to the zoning standards of the community in which they exist and provide documentation of sanitary sewer service or documentation from the Lake County General Health District noting the feasibility of a household sewage treatment system. 
     

    • Property Division

    The proposed division of land into buildable lots that is greater than twenty (20) acres.  Resulting lots must to conform to the zoning standards of the community in which they exist.
     

    •  Property Line Adjustment / Acreage Transfers

    The transfer of property between adjoining land owners that does not result in a new parcel being created on the tax duplicate. The result(s) of the property line adjustment shall not yield lots greater than five (5) acres. Adjustments that result in parcels over twenty (20) acres are referred to as acreage transfers. Similar to lot splits, both parcels in the transaction must conform to the local zoning standards.
